Introducing “La fabrique du droit”: A Conversation with Bruno Latour (Paolo Landri and Bruno Latour)

Abstract: Bruno  Latour  talks  with  Paolo  Landri  about  his  book  on  the  Conseil d’Etat (La Fabrique du droit). The conversation was held in 2006 at the time of the Italian  translation  of  the  book  and  illustrates  the  research  project  and  the difficulties the author had in the field. At the same time, it clarifies the trajectories of Bruno Latour’s work and theoretical framework of his program of study with respect to sociology, anthropology, and philosophy of law. The conversation helps to understand the open-ended character of Bruno Latour’s research and reflection including STS as well as sociological, anthropological and philosophical themes.

Latour’s revamped website

20 December 2011

While the new Bruno Latour website is mainly a reorganisation of the content that was already there, there are a few new features that are worth mentioning. First, the list of books has been updated and translations are more easily identifiable. Second, tags have been added to at least some of the books and articles, making it easier to find and identify works that have a common thread running through them. Check out for example the “modes of existence” tag. And third, there is now an RSS feed, so you can subscribe to notifications, every time a new item is added to the website.

“Reassembling Ethnography: ANT beyond the Laboratory”

Actor-Network-Theory (ANT) was literally developed in the laboratory, but it is an approach that proclaims usefulness to all arenas of social life. In recent years, ANT has been actively taken up in neighboring fields, such as Anthropology and Geography, but has only experienced slow and uneven interest within sociology. An upcoming edition of Qualitative Sociology aims to discuss ANT in relation to sociological ethnographic and qualitative methodologies. ANT’s call to ‘follow actors,’ its principle of symmetry, and its skepticism toward taken-for-granted categories in some way harkens to revered sociological traditions of ethnography, but at the same time challenges some of our existing conceptualizations and traditions of ethnographic research. This Special Issue brings together cutting-edge empirical articles that deploy/expand and dialogue with ANT’s ‘sociology of associations’ in various arenas of the social world.

The edition will be published in 2013. Edition articles will explore the usefulness of ANT as a method and as a theory to inform qualitative research, and ethnography in particular. We are interested in articles that will examine how ANT enriches our theoretical and empirical understandings of social phenomena, beyond its familiar domains in science and technology. Contributions are welcomed on a range of themes. The list below is not meant to be exhaustive and we encourage contributors to be creative in their application and engagement with ANT.

  • Race, ethnicity, gender, and class identities

The Special Issue will be edited by Gianpaolo Baiocchi, Diana Graizbord, and Michael Rodríguez-Muñiz (Brown University). The Editors welcome contributions engaged from doctoral or early career to established academics. The papers will undergo the usual peer-review procedure as established by QS.

“My best fiend” is a lecture series, which invites scholars to reflect on their academic enemies (from movements: Marxism, to persons: Talcott Parsons, to disciplines: anthropology, to concepts: “the other”). The goal of the series is to investigate the productivity of intellectual enmities.

Science and Technology Studies has highlighted the productive role of controversies to produce epistemic objects and sort the world. Controversies align scholars with methods, theories and schools of thought, they produce orientation in otherwise confusing seas of research. But controversies also pigeonhole people into camps. They undeservedly identify complex research identities with schools and theories and create guilt-by-association. The lecture series is calling for an analysis of such constellations by the protagonists themselves.

Enemies are productive. They spark interest, they draw energy, people care about them and they care about us. Why else would people spend time denouncing this badly formulated concept of an esteemed colleague, decrying the neighbouring discipline that keeps misunderstanding the world, or keep on writing bad tempered footnotes about this mistaken theory — and thereby become complicit in this very unproductivity? Why do scholars choose this enemy and not another?

Enemies also often involuntarily direct ones thinking, researching and theorising. If an enemy posits /a/, people feel compelled to posit /b/. If she writes approvingly of /c/, we need to denounce it. An enemy can have more power over people’s thinking than they would probably like to have it. It is as if people are guided in their thinking not only from their research object, but by an unknown field of do’s and don’t's, accumulated since the time of their studies, of where to go and look and where not to look.

The lecture series calls for analyzing the productivity of intellectual enemies. The speakers choose an enemy of their choice, and analyse his, her or its productivity for their own thinking, their research and their career. Doing so, they contribute to a new sociology of sociology. They revisit controversies and analyze them from within and beyond to engage in a sociological celebration of what they usually denounce.

The Hungarian Parliament

Continuing on the Hungarian theme, keep an eye on the Installing (Social) Order blog, where Endre Dányi is promising to provide a preview of  his doctoral (STS) research on the Hungarian Parliament. The excerpts from his first post below give you an idea about his project and his plans for the guest-blogging.

Hungarian Parliament

Sociologists and anthropologists of science know a lot about laboratories, innovation centres, museums, design studios, hospitals, and the politics of related material practices, but curiously there’s hardly any STS work that focuses on explicitly political institutions. Perhaps the most notable exception is the thousand page long Making Things Public: Atmospheres of Democracy catalogue, edited by Bruno Latour and Peter Weibel.

I can’t say I immediately had a clear idea about what an STS-informed research of a parliament would look like, but I knew where it could take place. As someone who grew up in Hungary, I remembered that the parliament building in the centre of Budapest was once the largest (and arguably the most impressive) of its kind – quite bizarre for a country that is not only small, but in most political scientists’ view also counts as a ‘new democracy’. Either they are right, I thought, and then props really don’t matter in politics, or the idea that liberal democracy in Central and Eastern Europe fell from the sky in 1989 – like in Peter Sloterdijk’s thought experiment  – needs to be rethought.

My plan in this space within the Installing (Social) Order blog is not to provide a summary of the dissertation, but to offer some sort of a problem map. First I will focus on architecture, and discuss what we can learn about liberal democracy if we concentrate on the construction of the Hungarian parliament building in the end of the 19th century. Then I will briefly recount what happened to this building (and the political reality it was supposed to hold together) in the 20th century in order to highlight some tensions related to the definition of a political community. I’ll then concentrate on the parliament’s role in the current political regime – the Republic of Hungary – and examine some of the most important aspects of the legislative process. After this, I’ll (re-)introduce my MP friend and summarise what I’ve learned from him about political representation, which sometimes takes place in the parliament building, but some other times in TV studios, party congresses, street demonstrations, and various other places. All of my stories will be full of political objects, but the picture wouldn’t be complete if I remained silent about political subjects.

A new book on Bruno Latour

Anders Blok and Torben Elgaard Jensen’s book on Latour has now come out in English: Bruno Latour: Hybrid Thoughts in a Hybrid World, published by Routledge. (The original Danish version came out in 2009, the same year in which Harman’s Prince of Networks was published.)

French sociologist and philosopher, Bruno Latour, is one of the most significant and creative thinkers of the last decades. Bruno Latour: Hybrid Thoughts in a Hybrid World is the first comprehensive and accessible English-language introduction to this multi-faceted work. The book focuses on core Latourian themes:

  • contribution to science studies (STS – Science, Technology & Society)
  • philosophical approach to the rise and fall of modernity
  • innovative thoughts on politics, nature, and ecology
  • contribution to the branch of sociology known as ANT – Actor-Network Theory.

With ANT, Latour has pioneered an approach to socio-cultural analysis built on the notion that social life arise in complex networks of actants – people, things, ideas, norms, technologies, and so on – influencing each other in dynamic ways. There is hardly anything that is not being evaluated on the web these days. Books, dishwashers, lawyers, teachers, health services, ex-boyfriends, haircuts, prostitutes and websites are just some examples targeted by novel review, rating and ranking schemes.

Used in an increasing number of areas, these schemes facilitate public assessment by soliciting and aggregating feedback and distributing it as comments, ranks, scales and stories. So how are we to judge the effectiveness of these schemes? What modes of governance are implicated in their operation? What is it to evaluate the evaluators – and will this business ever end?

Routine objections

There is an interesting debate unfolding on the pages of the current issue of the Journal of Institutional Economics, a special issue on Business Routines (Vol. 7, issue 2). It appears to mark the moment when institutional economics and the economic theory of the firm first encountered actor-network theory and its allies (unless I’d missed that moment happen somewhere else already).

The encounter was partly brought about by the confrontation between Teppo Felin & Nicolai Foss, who had launched a broadside against the literature of organizational routines, and Brian Pentland, who in turn rode to the rescue. Felin & Foss have been advocating for some time a “return to micro-foundations” in organisation studies (see e.g. Felin & Foss 2005), by which they seem to mean a return to methodological individualism, in the face of the methodological collectivism they perceive in the literature of organizational routines  (which can be traced back to Schumpeter and includes the evolutionary theory of the firm and the resource-based theory it inspired, as well as the more recent efforts to develop a theory of organizational routines by Feldman, Pentland et al.).

In their JIE paper Felin and Foss claim that the organizational routines literature considered the concept of the routine as a black box, where the inputs determine the outputs (somewhat reminescent of what Latour calls an “intermediary” in his Reassembling the Social):

In short, empiricist and behaviorist approaches postulate a strong, deterministic relationship between various inputs and associated outputs. Various external factors (whether stimulus, experience, environment, exposure, situation) essentially determine not only outcomes but also the internal make-up of the organism in question.

In response, they stand up for human agency which they feel is sidelined by the concept of organizational routine:

there is an opportunity to study the underlying ‘microfoundations’ of organization, that is to study the individuals that compose the organization, their underlying characteristics, nature, abilities, preferences, choices, and so forth.

There are three interesting responses to Felin & Foss by Sidney Winter (who disputes the above characterisation of the routines literature as empiricist and behaviourist), Geoffrey Hodgson and Thorbjørn Knudsen, and Brian Pentland. Let’s focus on Pentland’s response, as it draws directly on the tradition to which ANT belongs, and Pentland himself deployed ANT in some of his earlier work (e.g. Feldman & Pentland 2005, Pentland & Feldman 2007).

Already in his introduction, Pentland makes an ANT-ish observation of Felin and Foss’ critique:

They have created philosophical problems concerning organizational routines by disconnecting words from their meaning in practice; they write about ‘experiences’ and ‘routines’ in general, rather than writing about any specific experience or routine. (…) By avoiding empirical examples, and by overlooking or misrepresenting current theory, they create the impression that there are serious problems and confusion in the literature on organizational routines.

Pentland then stays true to the principles of ANT by using specific empirical examples to illustrate his argument that indeed there has been significant effort made in the ethnographic accounts of organizational routines to unpack the black box, which is far from a simple input-output switch. More importantly, and in contrast to the rationalist, choice-based humanist approach of Felin & Foss, Pentland makes the point that in his ethnographic study of organisational routines,

Multiple actors are involved. Dozens of people participated in processing invoices, but it is important to note that not all of the actors were human. Across the four organizations studied by Pentland et al. (2010), the percentage of actions taken by the humans ranged from 15 to 89%; the computerized workflow system performed the rest of the actions.

The main point of Pentland however is that Felin & Foss (and by implication, the economic theory of the firm and institutional economics) are unaware of the primarily sociological literature that has provided detailed empirical accounts of organisational routines for decades:

Some recent theories of organizational routines have been grounded in theories of structuration (Giddens, 1984) and practice (Bourdieu, 1990). Routinization is at the core of structuration theory (Giddens, 1984). Likewise, Bourdieu’s (1990) concept of practice centers on the repetitive, patterned activities that constitute habitus. These theories use different vocabulary and emphasize different things, but they have made a fruitful foundation for a theory of organizational routines (e.g., Pentland and Rueter, 1994; Feldman, 2000, 2003; Feldman and Rafaeli, 2002; Feldman and Pentland, 2003; Pentland and Feldman, 2005). This theoretical view is successful because it is supported by detailed ethnographic observation of a wide range of actual work practices, such as filing papers in an office (Suchman, 1983), photocopier repair (Orr, 1996), medical imaging (Barley, 1986), technology roadmapping (Howard-Grenville, 2005), software support (Pentland and Rueter, 1994), navigating a ship by sight (Hutchins, 1991), and many others.

The contributions of ANT-inspired approaches are brought up under their own heading (8: Routines are Socio-Material):

The most serious flaw in the current Felin and Foss paper (2011), and in their so-called ‘microfoundations project’ in general, is that it fails to incorporate current thinking about the ontology of organizational routines. (…) Contemporary scholars have adopted the term ‘sociomateriality’ to refer to this phenomenon (Orlikowski, 2007; Leonardi and Barley, 2008). Building on the work of Latour (2005), Law (2004) and others, Orlikowski has argued that: “…every organizational practice is always bound with materiality. Materiality is not an incidental or intermittent aspect of organizational life; it is integral to it” [emphasis in original] (Orlikowski, 2007: 1436).

Pentland’s intervention however wasn’t the only figuration of ANT in this special issue. Luciana D’Adderio has a separate paper focused solely on “Artifacts at the centre of routines: performing the material turn in routines theory,” making a strong argument for the agency of artefacts, drawing on STS and ANT:

Existing theories of organizational routines have generally had simplistic and extreme views of artifacts as fully deterministic or largely inconsequential. Artifacts have been treated as either too solid to be avoided, or too flexible to have an effect. This paper endeavours to improve our understanding of the influence of artifacts on routines dynamics by proposing a novel and deeper conceptualization of their mutual relationship. In drawing from recent advances in Routines and STS/Performativity Theory, the paper contributes to advancing our understanding of routines dynamics by bringing artifacts and materiality from the periphery to the very centre of routines and Routines Theory.

So there you have it: ANT and institutional economics face-to-face. Let’s hope that this debate results in some cross-fertilisation, although Foss’ initial response (“unfortunately Pentland has thoroughly misunderstood the nature of the micro-foundations projects we advocate”) suggests otherwise. However, Pentland and D’Adderio have provided plenty of pointers for where the theory of the firm could benefit from the insights of ethnographic studies inspired by ANT and related approaches. These approaches in fact share Felin & Foss’ desire to open up the black box of organisational routines: however, rummaging in the black box has already begun and it had found more than just ‘rational human actors’.

Addendum

After rereading my post I realised that it may give the impression that the above debate is about methodological individualism vs. methodological collectivism. Felin and Foss indeed seem to propose methodological individualism as an alternative to the methodological collectivism that they perceive in the tradition of the evolutionary theory of the firm (such as in Nelson & Winter 1982). However, the ANT perspective is decidedly neither individualist or collectivist. As a research approach, ANT is agnostic about the nature of an agent prior to an empirical inquiry and it allows for the seemingly strange possibility that an individual can enact collective agency and/or that a collective can act as an individual, and that individuals and collectives also include nonhuman entities. As Callon and Law (1997) put it:

Stable social arrangements are both individual and collective. They are necessarily possessed of a double nature. Sometimes it is useful to talk of individual entities: to imagine that they are discrete objects in an environment. But it is equally appropriate to treat them as collective effects – as patterned networks.

The argument, then, is that the division between the individual and the collective is an effect.

(…)

The distinction between individual and society is unnecessary. Indeed, it is seriously misleading. For the sociology of science and technology shows that the idea that society is a set of relationships between human actors is a misunderstanding. Instead it suggests that it is better understood as a collective association of human and non-human entities.
